10-th Annual Conference on Medical Negligence and Risk Management in Medicine, Surgery, Emergency Medicine, Radiology, Psychiatry and Family Medicine

It is, however, especially distressing to recognize that considerable harm (including disability and death) may be done to us by our health care providers. Reports that up to 100,000 patients may die annually as a consequence of medical errors would result, you would expect, in a national emergency, and dramatic steps taken to stop the carnage. Imagine a full jumbo jet crashing every day - or every second day - through a whole year! Would you not demand that your government take emergency steps to protect their citizens from medically administered harm? Thus far, stimulated by the original Institute of Medicine report, "patient safety" organizations have emerged, and changes in medical care are slowly percolating into the system. Meanwhile though, we are left firstly with the adversarial legal system - flawed as it is - that aims to sort out claimed medical negligence and errors of judgment from expected possible complications that occur during appropriate standard of care treatment. Secondly, we have the rapacious insurance system that preys on physicians whose costs inevitably add to everyone's medical expenses. Meanwhile, against the background of continuing advances in genetics and biotechnology, the practice of medicine remains exciting, but ever more challenging. The information explosion has let loose an endless stream of new facts, new tests, new claims, new concepts and novel approaches, all of which are hard to assimilate and apply to the frequently frenetic pace of medical practice. Moreover, all these advances have spawned changes in practice guidelines in all medical specialties. Failure to adhere to these new guidelines may ultimately invite unwanted litigation in the face of claimed medical malpractice and questions of competence. This conference brings into sharp focus new and established guidelines and standards of care, issues of competence, new advances, and ethics. An immediately preceding conference concentrates on pregnancy, its management and outcome, while this interdigitating and overlapping second conference takes up discussion along similar themes, but in multiple specialties. The aims of these conferences are to teach physicians to better comprehend the machinations of negligence law, and to develop a more complete awareness of the need for anticipatory and safety practices. The objectives are to also teach lawyers about the complex issues encountered in the practice of medicine, including the intricacies of decision-making, aiming to sharpen their understanding on behalf of their clients, both plaintiff and defense. The major objectives in these two conferences are to enhance the continuing education of a range of specialties in medicine including obstetrics, gynecology, midwifery, neonatology, medicine, surgery, family medicine, emergency medicine, psychiatry, cardiology, radiology and human genetics. Among the ingredients that have characterized the success of these conferences for over a quarter of a century are the additional objectives and lessons concerning the role of law and lawyers and better insights into the complexities of the legal process. Only through a thorough understanding of the challenges physicians face and recognition of the critical role lawyers have in influencing medical practice, can we hope to deal effectively with the continuing pressures of medical practice.
